YEREVAN. – The Constitution of Armenia functions solely de jure. Political and electoral technology analyst Armen Badalyan told the aforesaid Armenian News-NEWS.am on Constitution Day.

“The 1995 Constitutional and the 2005 Constitutional reform referendums have not complied with the fair and transparent principles, and the results were rigged in both cases.

“If we look at the actual reality, there is no Constitution today [in Armenia]. Even though it exists and functions de jure, given that Armenia is a semi-authoritarian state, [that] the judicial system does not function, [that] the law enforcement authority has turned into a pro-government body, [and that] the elections are falsified for a long time, it does not function de facto,” Badalyan said.     

As per the analyst, even the forthcoming constitutional reforms will give nothing to Armenia, except for the fact that the people will receive 10,000 drams (approx. $25)—as bribe—a day before an election.

“The people will gain nothing from the legal point of view. Just as the current Constitution doesn’t function, the next one will not function either.  

“[Even] if you write the best Constitution, what’s important is whether or not it is used,” Armen Badalyan added.
