Lawyer Robert Hayrapetyan posted the following on his Facebook page:

“On March 3, 2021, Tiran Khachatryan [former First Deputy Chief of the General Staff of the Armed Forces of Armenia] submitted a claim to the Administrative Court against President of Armenia Armen Sarkissian with the request to annul the latter’s decree dated February 24, 2021, and on March 10, 2021, the Court ruled to accept the claim for proceedings.

Within the meaning of Article 66 of the Administrative Procedure Code, Khachatryan’s claim is considered a disputed claim within the scope of which the plaintiff can demand complete or partial elimination of the interfering administrative act (in this case the decree).

As far as suspension of the decree is concerned, it is suspended by virtue of law. According to part 1 of Article 83 of the Administrative Procedure Code, acceptance of the disputed claim for proceedings shall suspend execution of the impugned administrative act before entry into legal force of the judicial act resolving the case on the merits under the particular case. Since the exclusive grounds provided for by points 1-6 of part 1 of Article 83 of the Code are prima facie missing, acceptance for proceedings already serves as a ground for suspending the impugned act and there is no need for an additional decision or position.”
