YEREVAN. – There is no legal case; Onik Gasparyan has been relieved of his post, whereas Artak Davtyan has been appointed to the corresponding position. Minister of justice Rustam Badasyan told this to reporters in parliament on Monday, referring to the prime minister's statement earlier that Davtyan is now considered to be appointed, by force of law, Chief of the General Staff of the Armed Forces of Armenia.

"I would advise to analyze, within the framework of constitutional security, what is meant by a decision that has entered into force by virtue of law, or any event following by virtue of law. (…) and I believe it is inappropriate—and is in the field of speculation—an interpretation there that it is possible to suspend a process or 'review' an already completed process by securing the lawsuit," Badasyan added.

On March 18, it became known that the Administrative Court had granted Onik Gasparyan's claim and apply a means of securing his lawsuit. According to his lawyer Artur Hovhannisyan, this means that Gasparyan continues to remain the Chief of the General Staff of the Armed Forces.

Commenting on the aforesaid court decision, the minister of justice said, however, that Gasparyan could not be reinstated to the abovementioned position. "I say very clearly, and the Office of the Prime Minister also has responded to it very clearly with a corresponding statement, interpreting the constitutional provisions. Moreover, the executive power has no right not to implement what is envisaged by the Constitution; that is, it cannot change its will because the Constitution has provided for a clear procedure, and its completion is regulated by decisions that enter into force," he explained.

The judicial act exists in reality, but according to Badasyan, it has no impact on the process. "We will see what will happen in the future during the trial. "You know that the provisions of the relevant law are being challenged in the Constitutional Court; what impact it will have on the administrative case, we will see the results by following the trial," the minister of justice added.
