The minister’s order was declared constitutional, and all the requirements are still in effect. This is stated in the press release issued by the Ministry of Health.
“The Constitutional Court has announced its decision on determining the constitutionality of the Law on Ensuring Sanitary-Epidemiological Safety of the Population of Armenia and the order of the Minister of Health.
The decision of the Ministry of Health with respect to COVID-19 PCR testing was declared constitutional since it arises from the interest of public health. Only the expression “the employee shall carry it out at his or her expense’” in all the appendices of the minister’s order was declared unconstitutional.
Nevertheless, taking into consideration the fact that the State doesn’t guarantee PCR testing under special conditions and free-of-charge, employees need to get tested in any case.
Thus, the order of the Minister of Health of Armenia was declared constitutional, and all the requirements are still in effect. Only the aforementioned phrase was declared unconstitutional,” the statement reads.
