The Criminal Court of Appeal, chaired by Judge Armen Danielyan, upheld the complaint of the prosecutor's office in the case of the Armenian second president Robert Kocharyan.

The ruling was published on the morning of February 6. It can be appealed in 15 days. Thus, the Court of Appeal quashed the ruling of the trial court. The lawyers were denied the full materials of the case on March 1, 2008. 

As reported earlier, the prosecutor's office filed an appeal against the ruling of the court of first instance to provide protection of the materials of the March 1, 2008 case. The prosecutor's office considers that publishing and even acquainting lawyers could harm the interests of others.

Robert Kocharyan's lawyers argue the materials of the part of the case set aside in separate proceedings against the ex-president and others were randomly selected, with the purpose of confirming the charge. Lawyers believe there may be materials in the case and in the interests of their client, familiarization with the materials can be carried out under a non-disclosure subscription, and if lawyers find it necessary to consider them ar court closed session. The arguments of the prosecution the law prohibits the publication of the case materials, which is being investigated, the lawyers counteract by asking for materials from the part, the investigation of which has already been completed.
