The National Security Service of Armenia has rejected institution of a criminal case based on the appeal filed by the attorney of Judge Davit Grigoryan, as reported Advisor to the Prosecutor General of Armenia Gor Abrahamyan.

“In regard to the position expressed by the Supreme Judicial Council on the lawfulness of sealing the door of the office of the judge of Yerevan first instance court of general jurisdiction and maintenance by police officers, I deem it necessary to state the following:

Back on July 17, 2019, the acting Prosecutor General of Armenia sent to the National Security Service of Armenia the communication that the attorney of the judge had submitted (the previous day) to the Police of Armenia in regard to the investigator of the Special Investigation Service of Armenia to verify the circumstances stated in the report.

In the communication, the attorney disputed the fact that the door of the office of Judge Davit Grigoryan was sealed illegally, violating the inviolability of the apartment of the latter since the office is equaled to the apartment as prescribed by law.

After preparing the report, the Investigation Department of the National Security Service of Armenia decided to reject institution of a criminal case on the ground of absence of corpus delicti of crimes provided for by Article 147 and Article 308 of the Criminal Code of Armenia.

I deem it necessary to emphasize that, in light of the statement by the Supreme Judicial Council, taking into consideration the fact that this decision might be appealed to the superior prosecutor, for the time being, we refrain from making any comment or expressing any position on this.

As far as the fact stated in the statement by the Supreme Judicial Council that a motion was filed to take relevant measures prescribed by law, the Prosecutor General’s Office still hasn’t received such a document, and we are still unaware of what this concerns,” Abrahamyan wrote.

Davit Grigoryan is the judge presiding over the criminal case involving Armenia’s second President Robert Kocharyan and several other former senior officials, and he had commuted Kocharyan’s pretrial measure of custody and ruled for his release from custody.
