The Human Rights Defender of Armenia has applied to the Constitutional Court with the request to guarantee the rights of police officers who are being criminally prosecuted, as reported the press service of the Human Rights Defender.

By the existing legislation, when a criminal case is instituted against a police officer, the latter is deprived of the opportunities to be paid a salary, resign from police service at own initiative and be appointed to another position, except for performing scientific, pedagogical and creative work.

In this situation, police officers face the issue of meeting their and their families’ primary needs when the guilt is not proven by the final judicial act.

As a result, this is a violation of several rights, particularly the rights to freedom of choice of work and respect for personal and family life, as well as the constitutional principles of prohibition of discrimination, presumption of innocence and proportion.
