The attorneys of second President of Armenia Robert Kocharyan have filed a motion for Judge Lusine Abgaryan’s self-recusal.

The motion is based on the attorneys’ suspicion about the judge’s impartiality and was filed before the closed trial during which the attorneys addressed the judge with a specifying question. This concerns the information of the mass media linked to the judge’s brother, Davit Abrahamyan, who is a friend of member of the Constitutional Court Vahe Grigoryan on Facebook. The other justification is that Judge Abgaryan’s name hasn’t been removed from the list of judges whom the case could have been inscribed to, even though it was inscribed before her vacation.

In response to the judge’s specifying questions whether there are facts about her subjective approach, the attorneys said there are no such facts, but taking into consideration that which was mentioned, there are substantiated doubts about objectivity. As for the last point about the vacation, the judge explained that she doesn’t draw up her schedule and doesn’t know how that happened.

Prosecutors Gevorg Baghdasaryan and Petros Petrosyan valued the motion as unsubstantiated.

The judge left for the consultation room. The decision will be announced on December 18 at 2 p.m.
