The motion filed by second President of Armenia Robert Kocharyan’s attorneys for termination of criminal prosecution continued during the trial over Robert Kocharyan and other ex-officials today.

Attorney Aram Vardevanyan reminded about Wikileaks, which has already presented by Armenian Public Television as a ground and on which the US Embassy has made a statement. The attorney noted that it would be interesting to see how the court would treat the data of Wikileaks. According to him, based on the recording of the sessions of the National Assembly, it is safe to deduce that former deputy Davit Harutyunyan had announced about the shortcomings of Article 300 of the Criminal Code of Armenia. “This means the shortcomings in the norms of the Criminal Code at the moment of the alleged act. In one case, an element of violence is implied, and in another — without violence. The current interpretation of Article 300.1 implies overthrow of constitutional order and without use of force. This can’t mean a mitigating circumstance since the scope of actions is being expanded,” Vardevanyan declared.

The attorney emphasized that the sharp change of viewpoint of the Prosecutor General’s Office regarding enforcement of Article 300.1 needs to be substantiated and noted that Article 300.1 was formulated in such a way that there is no unified opinion on its content.
