In July 2019, the Prosecutor’s Office of Kotayk Province of Armenia forwarded to the Kotayk Regional Police Department the letter of the head of the Urban Development, Technical and Fire Safety Inspection Body of Armenia stating that the violations committed by a Limited Liability Company during construction of a multi-apartment building were not eliminated after administration sanction and that the company continued construction, reports the Public Relations Department of the Prosecutor General’s Office of Armenia.

During preparation of the report, data was obtained, according to which the land plot pertaining to the Company by right of ownership was exchanged with 6 land plots serving as community ownership upon the decision of the Council of Elders of Abovyan city on December 3, 2018. In addition, the Company also performed construction works in the land plots belonging to the community and to several citizens (upon the consent of the latter).

Through preliminary investigation launched and being conducted by the Regional Investigation Department of the Investigative Committee in Kotayk Province under prosecutorial oversight, a decision has been rendered to engage Mayor of Abovyan V. G. as an accused-on-trial for performing prima facie acts under a particular article of the Criminal Code, and a charge has been brought against him.

With the obtained sufficient evidence, it has been substantiated that the mayor, being ex officio obliged to prevent and suspend further construction of the multi-apartment building and ensure elimination of the consequences of construction as prescribed by law, he intentionally didn’t perform his duties and failed to apply administrative liability measures against the persons who seized the land plot or are carrying out or have carried out construction.
