The trial over the case of second President of Armenia Robert Kocharyan and other ex-officials resumed after a 30-minute break.

The attorneys of Robert Kocharyan and ex-minister of defense Seyran Ohanyan are filing motions with the court today, and during the first half of the trial, Ohanyan’s attorney Karen Mezhlumyan filed a motion to apply to the Constitutional Court and suspend examination of the case.

In the second half of the trial, Kocharyan’s attorney Hovhannes Khudoyan filed his motion and stated that that even though the Constitutional Court has received an application with the request to determine the constitutionality of Article 300.1 of the Criminal Code of Armenia with the Constitution, the Constitutional Court hasn’t given a conclusion regarding Article 300, which was replaced by Article 300.1, meaning there has to be an evaluation of the constitutionality of Article 300 in comparison with Article 300.1 since Article 300 was in effect at the moment of the alleged crime.

According to him, this won’t increase the overload of the court, and in the legal sense, it will help answer many questions, without the answers to which continuation of the trial will be meaningless. “If Article 300 doesn’t comply with the Constitution, the trial should be stopped because Article 300.1 was introduced in 2009,” the attorney said.
