YEREVAN. – The Criminal Court of Appeal on Monday rescheduled the examination of the Prosecutor General's Office's appeal against the criminal case involving second President Robert Kocharyan, former Deputy Prime Minister Armen Gevorgyan, former CSTO Secretary General Yuri Khachaturov, and former Minister of Defense Seyran Ohanyan.

Gevorgyan's lawyer was not in the courtroom, as he is on vacation,.

The next court session was scheduled for July 24.

The Prosecutor General's Office has appealed the decision of the Court of First Instance to terminate the prosecution—along the lines of the tragedy that occurred in the capital Yerevan on March 1, 2008—against Kocharyan, Ohanyan, Khachaturov, and Gevorgyan under Section 1 of Article 300.1 of the Criminal Code, and to drop the criminal case under this section.

On March 29, the Constitutional Court recognized Article 300.1 of the Criminal Code as unconstitutional.
