The sixth garrison investigation department of Armenia's Investigation Committee's General Investigation Department has completed the preliminary investigation of 10 officers within the framework of criminal proceedings initiated over the refusal of servicemen to fulfill their duties under martial law.

The press service of the Investigative Committee informed NEWS.am that as a result of the large-scale investigative and procedural actions, a number of circumstances were revealed. Factual evidence revealed that during the aggressive war unleashed by the military-political leadership of Azerbaijan against Artsakh on September 27, 2020, under martial law, the staff of the 2nd Infantry Battalion of the military unit went to participate in the hostilities under the order of the commander of the 1st military unit of October 18, 2020. However, a number of servicemen of the battalion, including the commander and nine officers, refused to perform certain military service duties on the way and returned to the place of permanent deployment of the military unit.

The commander and nine officers of the battalion were charged under part 3 of article 364 of the Criminal Code of Armenia, adopted on April 18, 2003 (corresponds to part 3 of article 529 of the Criminal Code of Armenia, which entered into force on July 1, 2022).

A new proceeding with respect to the mentioned 10 officers was instituted, which together with the indictment was sent to the prosecutor's office to solve the issue of sending it to the court.
