YEREVAN. – Robert Kocharyan's lawyer, Hovhannes Khudoyan, filed a motion that the presiding judge, Anna Danibekyan, recuse herself from presiding over this case.

The lawyer recalled that on September 20, the judge rejected the motion to release Kocharyan.

The lawyer also recalled the Constitutional Court decisions, which also mentioned the necessity of justifying the decision and the alternative of detention.

Taking into account the court's subjective negative attitude, Khudoyan motioned for the presiding judge's recusal. The lawyer brought examples Judge Danibekyan's other decisions she had made in similar situations.

Defense attorneys Aram Vardevanyan and Ruben Sahakyan also presented their respective arguments.

The prosecution opposed the motion.
