The procedure for paying fair compensation, as well as submitting necessary documents, stipulated by the judgments and decisions of the European Court of Human Rights (ECHR), has been established in Armenia.

The respective Armenian government resolution clarifies the procedure for providing fair compensation amounts and establishes the list of documents that the applicant, the latter’s representative or legal successor must submit to receive the amount. These include the application, a bank statement, a copy of an identity document, and several other necessary documents.

It is noted that in practice, problems arose in the process of receiving compensation due to incomplete or late submission of documents. As a result, the staff of the prime minister of Armenia often could not transfer the amounts within the established deadlines. In addition, the domestic legislation lacked legal regulation of the process of paying fair compensation.

The adoption of this draft will enable clarifying these legal relations, ensuring timely and efficient payment, as well as properly implementing Armenia's obligations arising from the ECHR rulings.
