YEREVAN. – Parents of the Armenian citizen who died in Azerbaijan's captivity may file a petition to the European Court of Human Rights if the matter is humiliation, lawyer Ara Ghazaryan told Armenian News-NEWS.am.

As regards the fact that the Armenian Foreign Ministry will present the evidence on public humiliation and murder of an Armenian citizen to the international agencies, Ghazaryan said  if international organizations adopt any resolution, it will be useful as a political document in the legal field. 

In case person's rights are violated, parents of the deceased can file a petition.

“The government may also apply to certain authorized structures to clarify their position, which, in turn, can be used in the political field. The state may submit an appeal on its behalf against another state, if the goal is to apply international instrument collectively,” he emphasized.

For example, Armenia can file a lawsuit against Azerbaijan based on armeniaphobia, the fact that every citizen of Armenia is facing a threat of discrimination because of being an Armenian, since Azerbaijan is breaching article 14 of the international conventon on human rights. 

“Armenia can bring hundreds of examples and evidence of such a policy: anti-Armenian statements by high ranking officials and personally by the president of Azerbaijan, the case of Ramil Safarov. Armenia may decide to file a petition against Azerbaijan when all diplomatic measures are exhausted,” Ghazaryan added.

Karen Petrosyan, a resident of Chinari village, was taken captive on August 7, and on the next day Azerbaijani side reported about his death of “a heart failure”.

At the same time Azerbaijani side tried to present a civilian as a saboteur. Azerbaijani media spread footage of Petrosyan dressed in a camouflage vest. The video strongly contradicts the one shot during the first minutes of his stay on the Azerbaijani side – Karen is sitting and talking to villagers without a vest.
