YEREVAN. - The new regime of the turnover tax can reduce the turnover of counterfeit trademarks, Armenian lawyer Artak Mikayelyan told Armenian News – NEWS.am.
According to him, the new regime stimulates small and medium businesses to execute transactions in order to be eligible for 1 instead of 5 per cent tax. In this case it will be difficult to conceal the real volumes of purchase and sale of counterfeits and this can help assess the damage to the trademark holders, the lawyer said.
Even if such cases recur, the trademark holder will be able to substantiate his loss to start a lawsuit. “The Criminal Code stipulates punishment for the sale of counterfeit goods, the cost of which exceeds 200 thousand AMD. And in the absence of transaction documents, haw can the amount be determined? Only on the basis of the plaintiff’s claim. And without documents it’s naturally more difficult to substantiate this. That’s why I think that the document flow in case of the new regime will help significantly reduce the turnover of goods with counterfeit trademarks,” Mikayelyan said.
