YEREVAN. - The representative of the legal successor of the aggrieved party in the Avetisyan family murder case, attorney Aramazd Kiviryan, demands the Appellate Court to cancel the decision of the Court of General Jurisdiction. The latter refused to allow the civil claim on moral damages.
According to the attorney, the Court of General Jurisdiction allowed the claim, but made a contradictory decision a month later, ordering to disallow it.
The court explained its position by the fact that the legislation doesn’t provide for moral damages, citing two decisions of the Appellate Court. However, the aforementioned decisions were taken before 2014, that is before the relevant provisions of the Civil Code had taken effect. Besides, there is a relevant Constitutional Court decision. The European Court of Human Rights also considers that the right to moral damages shouldn’t be violated.
The sides didn't oppose the appeal. The next hearing will take place on December 5.
