YEREVAN. – The European Court of Human Rights has stated that Switzerland has violated the right of freedom of expression in its decision on “Mercan and others v. Switzerland case”.

The decision did not come as a surprise, Swiss Federal Department of Justice and Police said in response to the Armenian News-NEWS.am written inquiry.

“The decision didn’t come as a surprise because the Mercan case is very similar to the Perincek case. The Courts jurisdiction demands a restrained application of the anti-racism provision in the Swiss Criminal Code but doesn’t exclude cases in which a conviction according to that provision is compliant with the freedom of expression,” said Folco Galli, spokesperson for the department.

Back in 2010 the Swiss federal court named three Turks guilty of racial discrimination and denial of the Armenian Genocide. Ali Mercan, Hasan Kemahli and Ethem Kayali appealed to the European Court of Human Rights (ECHR).

According to the ECHR judgment as of November 28, the Swiss government will have to pay a compensation amounting to 4,988 euros and 25,156 euros.
