YEREVAN. – Formation of transitional justice bodies in Armenia depends on which of the three components of the Constitutional justice will be chosen, the deputy from the Republican Party of Armenia, head of the standing parliamentary committee on state and legal issues and human rights Gevorg Kostanyan told reporters on Wednesday.

According to him, constitutional justice has three components that replace the judicial system: carrying out justice, supporting justice, and compensation mechanisms for damages.

“The creation of an appropriate body that replaces the judiciary is prohibited in the EU member states by the European Convention. Therefore, choosing this model, we will have serious problems with the European Convention on Human Rights,” said Kostanyan, former Armenia’s Attorney General.

According to the deputy, the second component is a subsidiary body for the administration of justice. It is formed in the countries where there are no bodies carrying out the investigation, or the credibility of them is undermined in society.

The third component is the creation of mechanisms for compensating the damage conditioned by compensation for the damage caused earlier, as well as for wider work with the population, Kostanyan added.

According to Kostanyan, he does not know which of these three components is preferred by the Armenian Prime Minister Nikol Pashinyan.
