Only after reading the decision of the Constitutional Court will it be possible to say whether second President of Armenia Robert Kocharyan will be released from criminal prosecution or not following promulgation of the Court’s decision. This is what Robert Kocharyan’s representative, lawyer Aram Vardevanyan told journalists today.

“The decision of the Constitutional Court is binding for courts, the government and everyone, for that matter. Failure to implement a decision of the Constitutional Court is generally a criminally prosecutable act. A preventive measure can be reviewed by the Penitentiary Service or the body conducting proceedings, and in this case, the body conducting proceedings is the first instance court under the chairmanship of Judge Danibekyan,” he said.

When asked if this means the court has to immediately examine the preventive measure and release Kocharyan, Vardevanyan said, in this case, the full text of the decision of the Constitutional Court has to be promulgated in order for him to present all the actions. He also emphasized that the first instance court must commute the decision on detaining Robert Kocharyan.

Today, the Constitutional Court of Armenia partially granted the application of second President of Armenia Robert Kocharyan and recorded that there is no regulation for immunity among the circumstances excluding criminal prosecution, meaning this is unconstitutional. The Constitutional Court also recognized the grounds for applying preventive measure for Robert Kocharyan as constitutional.
