In the first quarter of 2020, Armenia will set up a commission for constitutional amendments that will consider the issue of making amendments to the Constitution and will submit the draft amendments to the Constitution. This is stated in the draft decision of the Government of the Republic of Armenia “On approving the 2019-2023 Republic of Armenia Strategy for Judicial and Legal Reforms and its Action Plans” which has been posted on the Unified Website for Publication of Legal Acts’ Drafts.

According to the draft, the Commission for Constitutional Amendments shall, among other issues, discuss several conceptual issues, including the direct action of the Constitution; the place of international treaties in the legal system of the Republic of Armenia; the peculiarities of the applicability of regulatory legal acts adopted by the particular supranational institution at the moment of acceding to the particular supranational institution; the scope of powers granted to the bodies provided for by the Constitution; the procedure for election of deputies of the National Assembly and formation of the majority in parliament, as well as the number of deputies, the issues related to the formation and powers of other bodies subordinate to the Government, to the Prime Minister and to ministries as provided for by the Constitution, separation of powers and checks-and-balances of the bodies provided for by the Constitution, the procedure for formation of the Supreme Judicial Council and the role and powers of the Supreme Judicial Council, etc.

The Ministry of Justice anticipates the active participation of all interested parties in submitting opinions and recommendations regarding the draft submitted for public deliberation.
