YEREVAN. – One of our goals is for Robert Kocharyan to be released immediately, and the ultimate goal is that the criminal proceedings against Kocharyan be stopped. Attorney Hayk Alumyan, a member of the legal defense team of Armenia’s second President Robert Kocharyan, on Tuesday told this to reporters at the Constitutional Court.

Alumyan noted that people are under the false impression that the Constitutional Court is currently considering whether or not to release Kocharyan from custody.

“The Constitutional Court is considering whether those laws that have been applied are in conformity with the Constitution [of Armenia],” he said, “and whether the judicial practice formed regarding those laws runs counter to the Constitution.

“Today, the Constitutional Court isn’t considering the matter of releasing-not releasing Mr. Kocharyan from custody.”

The Constitutional Court is considering—by a written procedure—the petitions by Armenia’s second President Robert Kocharyan, the key defendant in the criminal case into the tragic events that occurred in capital city Yerevan, in March 2008.

The second president has asked the high court to consider the constitutionality of the two articles of the Criminal Procedure Code, and with respect to the grounds for applying pretrial measure, and the circumstances that rule out the proceedings of the criminal case or the criminal prosecution against him.

The Constitutional Court will announce its respective ruling on Wednesday.
