Armenia is obliged to pay EUR 3,600 to the Iranian national Avanes Avakemyan as per the judgment of the European Court of Human Rights in the case Avakemyan vs. Armenia.

Avakemyan lodged a complaint with the ECHR in October 2009. According to him, the authorities failed to ensure the enforcement of the final judgments of local courts in his favor.

Earlier, the applicant brought a claim in the Arabkir and Kanaker-Zeytun District Court of Yerevan against K., a private individual, seeking payment of a certain amount of money. Before the beginning of the court’s examination of the case the applicant and K. concluded an agreement to settle the debt, which envisaged, inter alia, a time-frame for payment. However, K. failed to comply with the terms of the settlement.

The court rendered judgments on the case in 2005, 2007 and 2008, but none of them was enforced.

The ECHR held that the authorities failed to enforce the judgments in favor of the applicant, this being a violation of human rights.
