There can’t be an issue on commuting the preventive measure based on the Constitutional Court’s decision in regard to the case of second President of Armenia Robert Kocharyan. This is what Minister of Justice of Armenia Rustam Badasyan declared in an interview broadcast on Shant TV.

When asked if the Constitutional Court was competent to adopt a decision regarding the case of Kocharyan, Badasyan said the following: “With respect to competence, you are aware that one of the judges of the Constitutional Court has presented arguments about the impossibility of participation of at least three members of the Court, and in that regard, the Constitutional Court hasn’t rendered any decision. If, in any case, there were data about impossibility, it was the duty of the judges of the Constitutional Court to inform about this and render a decision through the prescribed procedure. In some sense, the process was doubtful.”

According to Rustam Badasyan, all decisions of the Constitutional Court are binding.
