The court postponed the rendering of its decision based on the motions filed by the attorneys of second President of Armenia Robert Kocharyan and ex-defense minister Seyran Ohanyan until clarification of circumstances that are important for the trial.

As reported earlier, attorney Karen Mezhlumyan had filed a motion to apply to the Constitutional Court of Armenia to determine the constitutionality of Article 300 of the Criminal Code (Article 300 was in effect at the moment of the alleged crime, and later it was replaced by Article 300.1), and attorney Hovhannes Khudoyan had filed a motion to apply to the Constitutional Court to determine the constitutionality of Article 300.

According to the attorneys, it will be impossible to assess the charge brought up without determining the constitutionality of Article 300.

Judge Anna Danibekyan listened to the sides and ruled that it will be impossible to take a decision in this stage. She recalled that the issue is being considered by the Constitutional Court and an appeal has been filed. In this regard, the decision based on motions will be rendered after the Constitutional Court and the Court of Cassation make their decisions.
