YEREVAN. – Zhoghovurd daily of the Republic of Armenia (RA) writes: Onik Gasparyan has not been relieved of the post of Chief of General Staff of the RA MOD [Armed Forces], and he can go [back] to [this] work by virtue of law and fulfill his General Staff duties.

The thing is that Judge Mher Petrosyan of the RA Administrative Court has accepted the lawsuit of the chief of the General Staff Onik Gasparyan, and in this case, Article 83 of the Code of Administrative Procedure clearly states that if a challenge has been filed against an administrative act and the court has accepted [it], the implementation of that act is suspended by virtue of law until there is a final judicial act on the case.

It turns out that Onik Gasparyan has to return to work [as Chief of the General Staff of the Armed Forces].

Let us recall that on February 25, the RA Prime Minister had submitted to the President of the republic a proposal on dismissing the Chief of the General Staff of the RA Armed Forces Onik Gasparyan from his post, attaching the draft of the respective decree.

The President returned it, with objections. On February 28, a letter was sent to the RA President with relevant justifications, and Onik Gasparyan was relieved of his post by virtue of law. And now it turns out that after applying to the court, Gasparyan remains the chief of the General Staff by virtue of law.
