Today marked the end of examination of the appeal filed by the attorneys of second President of the Republic of Armenia Robert Kocharyan to terminate criminal prosecution against Kocharyan under the ground of immunity. The investigator provided the court with copies of the judicial acts, after which the Court of General Jurisdiction of Yerevan, chaired by Gagik Poghosyan, left for the consultation room to render a decision, which will be announced on 12 April at 9:30.

According to the attorneys, the right of Robert Kocharyan to personal freedom and immunity — envisaged by Article 5 of the European Convention on Human Rights and Article 27 of the Constitution of the Republic of Armenia — and his right to immunity as former president of the Republic of Armenia, envisaged by Article 142 of the Constitution of the Republic of Armenia, have been violated.

The provision on immunity of the President of the Republic of Armenia is enshrined in the former and current Constitutions of the Republic of Armenia, particularly part 2 of Article 140 of the Constitution of the Republic of Armenia.

Robert Kocharyan is charged under part 1 of Article 300.1 and point 2 of part 4 of Article 311 of the Criminal Code of the Republic of Armenia for overthrowing the constitutional order of the Republic of Armenia and receiving a bribe in particularly large amounts.
