YEREVAN. - Yerem Sargsyan, attorney of David Khachatryan, convicted to 17 years for the murder of his comrade-in-arms and soldier Lyuks Stepanyan, has filed a complaint with the European Court of Human Rights (ECtHR), Sargsyan told Armenian News – NEWS.am.
According to him, the complaint is against the decision of the court, since the principle of fair trial stipulated by the European Convention of Human Rights (ECHR), was violated. Sargsyan said several provisions of the ECHR, including the presumption of innocence, were also violated. Besides, the relatives of the killed soldier pressured the court, he added.
There are no terms for waiting for ECtHR response; if it was necessary to wait for 3-4 years before, now this takes only 2 years.
On 15 May 2013, Private David Khachatryan, 19, fired from his gun at the military unit. Consequently, Private Lyuks Stepanyan was wounded in his head and immediately died, while another soldier, Hrachya Sargsyan, was wounded in his head.
