European member states have not yet deployed a dispute resolution mechanism for a nuclear deal that could restore sanctions against Tehran, said Iranian MFA spokesman Abbas Mousavi.

 “Europe has not activated the trigger mechanism yet. They wanted to, but didn’t after they heard Iran’s reasoning and arguments. Mr. Zarif wrote a 14-page letter to Mr. Borrell in which all of these reasons were explained.”

According to him, Zarif wrote a letter to Borrel about the arguments of European states regarding actions on a nuclear deal in the light of the intention to launch a dispute resolution mechanism. The trip of the head of EU diplomacy to Iran is an opportunity to share his arguments with the European side, Mousavi added.

Iran’s MFA spokesman also touched on the upcoming joint nuclear deal commission, which is expected to take place in February.

It was agreed to hold a joint commission in the near future, but the date and place (of its holding) has not yet been determined, Mousavi added.

Germany, France and the UK have announced the launch of a dispute resolution mechanism for a nuclear deal with Iran due to Tehran’s refusal to fulfill part of its obligations under the document. Europeans have been discussing the adoption of this measure, but decided to take this step only after Iran, as part of a phased reduction of its obligations under the Iranian deal.

A dispute settlement mechanism is provided in case one of the parties to the nuclear deal considers that Iran is not fulfilling its obligations under it, as part of the UN Security Council resolution.

If the dispute is still not resolved, the parties may declare its conditions are not fulfilled at a meeting of the joint commission and after a certain period of time notify the UN Security Council of a gross violation of the Iranian deal. The Security Council should vote on the extension of the regime for lifting sanctions against Tehran. All UN Security Council sanctions will be restored if it is not adopted after 30 days.
