Lawyer Alexander Kochubayev has been charged under a Criminal Code article that does not correspond to the alleged act, lawyer Varazdat Arutyunyan stated at a press conference on October 24.

According to Arutyunyan, Kochubayev is accused under Article 490, Part 2, which presumes the publication of information that defames or harms the interests of members of the judicial, prosecutorial, and other systems, as well as their families.

“You are all familiar with the publication. It can be classified as an insult or anything else, but not as the publication of factual information. This article was simply used as a reason to arrest him. In other words, the description of the act does not match what actually happened, and we consider the arrest illegal,” the lawyer emphasized.

It is worth recalling that the arrest stemmed from a recording referring to “investigators, prosecutors, and judges who sold their souls to Satan.” The recording was made because law enforcement officials refused to disclose the location of the summoned Mkrtych Srbazan. Now the court and the investigation will have to prove that the phrase “sold their souls to Satan” constitutes a factual statement about a deal.
